Welcome to Medito Foundation. These Terms of Service ("Terms") govern your use of our website (meditofoundation.org) and mobile application (Medito, available on iOS and Android). By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use our services.

1. Use of Our Services

1.1. The Medito app is free to download and use.

1.2. Some features or content might require a donation to access. This will be clearly indicated within the app.

1.3. We may update our services periodically to improve functionality, fix bugs, or add new features.

2. Donations

2.1. All donations to Medito Foundation are voluntary.

  • Single Donation: A one-time contribution of your chosen amount.
  • Monthly Donation: A recurring monthly contribution of your chosen amount until cancelled.

2.4. Your choice of donation type and amount is your personal decision. The donation page and in-app flow clearly explain your options and any associated benefits.

2.5. By setting up a donation, you authorize Medito Foundation to charge your chosen payment method. For monthly donations, this authorization remains valid until cancelled by you.

  • Within 14 days of donation: Full refund without need for justification.
  • After 14 days: Refunds may be provided at our discretion, particularly in cases of error or dissatisfaction.
  • Duplicate charges: Full refund of the duplicate amount.

2.8. As a nonprofit organization, we are committed to using donations responsibly and in accordance with our charitable purposes.

3. Intellectual Property

3.1. The Medito app's source code is open-source, licensed under the GNU Affero General Public License (AGPL).

3.2. Content within the app and website is copyrighted by Medito Foundation.

4. User Accounts

4.1. You may need to create an account to access certain features.

4.2. You are responsible for maintaining the confidentiality of your account information.

4.3. You must notify us immediately of any unauthorized use of your account.

5. Privacy and Data Protection

8.2. If the dispute cannot be resolved through direct communication, both parties agree to attempt to resolve the dispute through mediation before resorting to binding arbitration or litigation.

8.3. Any arbitration will be conducted in accordance with the rules of the Netherlands Arbitration Institute.

8.4. Nothing in this section prevents you from bringing your dispute to the attention of any federal, state, or local government agencies that can, if the law allows, seek relief from us for you.

We reserve the right to modify these Terms at any time. We will notify users of significant changes through our website or app. Continued use of our services after changes constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

10.1. These Terms are governed by the laws of the Netherlands, without regard to its conflict of law provisions.

10.2. Any legal action or proceeding relating to your access to, or use of, our services or these Terms shall be instituted in a court of competent jurisdiction in the Netherlands.
